1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between Domi's Custom Discord Bots ("Company", "we", "us", or "our") and the user ("you", "your"). These Terms govern your access to and use of all products, services, and features provided by Domi's Custom Discord Bots, including but not limited to our custom Discord bots, hosting services, technical support, integrations, and other related services ("Services").

3. Services and Usage

3.1 Service Availability

We provide custom Discord bots, hosting, and related services to our users. While we strive to ensure that the Services are available 24/7, we do not guarantee uninterrupted or error-free access to the Services. We reserve the right to suspend or limit access to the Services for maintenance, upgrades, or security reasons.

3.2 Usage Rights

By using the Services, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the Services in accordance with these Terms. You do not have the right to sublicense, sell, or distribute any of the Services or the underlying technologies, including the bots we develop for you.

Payments are processed through third-party payment processors. You agree to provide accurate and up-to-date payment information and acknowledge that we are not liable for any issues arising from failed or incomplete transactions.

5.3 Refund Policy

Unless otherwise required by law, all payments are non-refundable. We may issue a refund in the event of a technical failure or billing error caused by our system.

5.4 Subscription Cancellations

You agree to indemnify and hold Domi's Custom Discord Bots harmless from any claims, damages, liabilities, and costs arising from your use of the Services, including any third-party claims resulting from your violation of these Terms.

7.3 Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Services, including but not limited to data loss, loss of profits, or damage to reputation.

8. Suspension and Termination

8.1 Termination by You

You may terminate your account and subscription at any time by following the instructions in your account settings. Upon termination, your access to the Services will be revoked, and your data may be deleted.

8.2 Termination by Us

We reserve the right to suspend or terminate your access to the Services if you violate these Terms, including engaging in prohibited activities, failing to pay subscription fees, or violating intellectual property rights. We may terminate your account without prior notice.

9. Loopholes and Attempts to Circumvent Terms

9.1 Prohibition on Loopholes

You acknowledge that attempting to exploit any loopholes or circumvent these Terms in any way, including bypassing restrictions, reverse engineering, or modifying the Services or the bots, is strictly prohibited. Any such attempt is considered a violation of these Terms.

9.2 Legal Consequences of Loophole Exploitation

If you attempt to exploit or find a loophole in these Terms, you acknowledge that this is a criminal offense under applicable laws, including those in Austria, and we may pursue legal action against you. This may result in:

• Immediate termination of your account and access to our Services.

• Legal action for any damages caused, including but not limited to legal fees, fines, or penalties.

• Reporting to law enforcement authorities if your actions are deemed illegal.

9.3 Continuous Monitoring

We continuously monitor the system for irregularities, unauthorized access, and any attempts to bypass our systems. Any such activity will result in permanent suspension and could lead to criminal charges.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes related to these Terms will be resolved under Austrian law.

10.2 Dispute Resolution

Any disputes, claims, or disagreements arising from these Terms or your use of the Services will be resolved through binding arbitration in accordance with the rules of the Austrian Arbitration Association.

10.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts in Linz, Austria, for any disputes arising out of these Terms.

11. Additional Terms and Conditions

11.1 Force Majeure

We are not responsible for any failure to perform due to events beyond our control, including natural disasters, government actions, or technical failures.

11.2 Severability

If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force and effect.

11.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Domi's Custom Discord Bots regarding your use of our Services.
